According to the House deal to change the Foreign Intelligence Surveillance Act (FISA), telecom companies would receive immunity from lawsuits for participating in the White House wiretapping program if they obtain a waiver from their state’s attorney general, something that amounts to “less than nothing,” Yglesias writes. Barack Obama, should he become president, shouldn’t retain Robert Gates, a Republican, as Secretary of Defense, since that would reinforce the idea that Democrats can’t handle national security, Yglesias writes.
