Report: High court rejects petition to halt gay marriages in Calif.

The Supreme Court on Sunday rejected an emergency petition from a group asking to stop same-sex weddings in California.

Theodore J. Boutrous Jr., one of the lawyers who challenged that state’s Proposition 8, which banned gay marriage, said that Justice Anthony Kennedy had denied a request from the group ProtectMarriage to put a hold on all same-sex marriages.

{mosads}Boutrous told the Los Angeles Times, which first reported the decision, that Kennedy did not provide any comment.

The petition from the group came after the high court on Wednesday declined to rule on Proposition 8 on procedural grounds, leaving in place a district court ruling holding the law unconstitutional. 

The Ninth Circuit Court of Appeals lifted its stay on a 2010 court order invalidating Prop. 8 on Friday, allowing officials to begin presiding over same-sex marriages. 

ProtectMarriage which backed Prop. 8 backers challenged that decision, arguing that circuit courts must wait 25 days before acting on a case decided by the Supreme Court and that the order violated rules.

According to reports, Prop. 8 backers may ask another justice to reinstate the hold on same-sex marriages.
