Amendment Would Decide Electoral College Tie With Simple House Vote
Rep. Brad Sherman (D-Calif.) has introduced a constitutional amendment seeking to change the way the House of Representatives chooses a president in the case of an Electoral College tie.
Under the 12th Amendment, if there is a tie in the Electoral College, each state is allotted one vote, which is determined by the representatives of each state. The Sherman amendment would give each representative a vote, making the presidential contest subject to a simple majority vote of the representatives, instead of a majority vote of the states.
