Parents suing Wisconsin school district over gender identity policy

Two sets of parents have filed a lawsuit against the Kettle Moraine School District over its new gender identity policy.

The lawsuit, filed Wednesday in the Waukesha County Circuit Court by Wisconsin Institute for Law and Liberty and the Alliance Defending Freedom, is in response to a district policy that allows students, including minors, to determine their names and gender pronouns used in the school without parental consent.

“The Kettle Moraine School District’s policy violates parents’ constitutional rights to raise their children by taking a major, controversial, and potentially life-altering decision out of parents’ hands,” the Wisconsin Institute for Law and Liberty wrote in a news release.

One set of parents became involved in the lawsuit after they allege their 12-year-old daughter “began to question her gender in December 2020” and was allowed to identify by a male name and pronouns while at school.

“The family sought professional and medical support for her, and after extensive research, decided that immediately transitioning would not be in her best interest,” the Wisconsin Institute for Law and Liberty said. “They communicated this directly to Kettle Moraine School District staff in January 2021, and asked staff to continuing referring to their daughter using her legal name and female pronouns. But the Kettle Moraine School District refused to honor their decision.”

The family removed their daughter from the school. Information about the second set of parents involved in the lawsuit hasn’t been made available.

Kettle Moraine School District declined to comment, citing the ongoing litigation.
