Protester shoved to the ground by Buffalo police has fractured skull and can’t walk

Martin Gugino, the 75-year-old protester who was seen on video being pushed to the ground by two Buffalo, N.Y., police officers earlier this month has a fractured skull, is unable to walk and remains in the hospital, according to a statement provided to CNN by the man’s lawyer. 

“I am not at liberty to elaborate at this time other than to confirm that his skull was fractured,” Gugino’s lawyer Kelly Zarcone told the news outlet. “While he is not able to walk yet, we were able to have a short conversation before he became too tired. He is appreciative of all of the concern about him but he is still focused on the issues rather than himself.”

Video of the June 4 incident showing the officers pushing the 75-year-old man on his back and leaving him on the sidewalk motionless and bleeding from his head went viral, prompting swift criticism of law enforcement’s handling of protesters.

The Buffalo Police department initially said Gugino tripped and fell, but later changed their statement and suspended the officers without pay and opened an investigation. 

Officers Aaron Torgalski and Robert McCabe have each pleaded not guilty to second-degree assault and have been released on their recognizance without bail, CNN reports. 

President Trump in response last week shared an unfounded conspiracy theory about the incident, suggesting Gugino was part of the far-left group Antifa. 

“Buffalo protester shoved by Police could be an ANTIFA provocateur. 75 year old Martin Gugino was pushed away after appearing to scan police communications in order to black out equipment,” Trump tweeted last Tuesday referring to a report from One America News Network (OANN). 

“I watched, he fell harder than was pushed,” Trump added. “Was aiming scanner. Could be a set up?”
