Republican strategist Mattie Duppler on Monday said that the way the Obama and Trump administrations have handled the legal definition of gender has created ambiguity in the application of laws.
“There’s a belief that it is a subjective definition. That’s exactly what the Obama administration said. It said this binary definition that we’ve used for years and years and years doesn’t work anymore, but essentially it said ‘up to you, courts and agencies, to define, then, what that looks like,’ ” Duppler, founder and president of Forward Strategies, told Hill.TV’s Buck Sexton and Juanita Tolliver on “Rising.”
“That’s why now there is tension between actual application of the law, and what that looks like moving forward,” she continued.
“I’m not sure what the answer is, but as I mentioned before, I think that the way both administrations have handled this creates too much ambiguity,” she said.
The New York Times reported on Sunday that the Trump administration was considering tightening definitions of gender by requiring individuals to identify as male or female based on their genitalia at birth.
Obama-era rules originally granted more freedoms to people who identify as transgender.
LGBTQ groups have since announced rallies to push back on the proposal reported by the Times.
