Trump slams district court over travel ban, sanctuary cities rulings

President Trump early Wednesday slammed the U.S. Court of Appeals for the 9th Circuit over its rulings against the administration.

A district court judge in San Francisco, not the 9th Circuit, as Trump claimed, blocked enforcement of the executive order barring federal funds from so-called sanctuary cities that refuse to cooperate with federal immigration authorities.

The 9th Circuit will hear the White House’s appeal of the lower court’s ruling.

{mosads}San Francisco and Santa Clara County won preliminary injunctions to block the president’s January order to withhold funds from cities that refuse to comply with federal authorities in enforcing immigration laws.

Trump was dealt a defeat earlier this year by the same court, which upheld a nationwide block on his original travel ban on refugees and people from certain predominantly Muslim countries.

“Out of our very big country, with many choices, does everyone notice that both the ‘ban’ case and now the ‘sanctuary’ case is brought in … the Ninth Circuit, which has a terrible record of being overturned (close to 80%). They used to call this ‘judge shopping!'” the president added early Wednesday.

According to Snopes, less than 0.001 percent of the circuit court’s decisions are reviewed by the Supreme Court.

During a signing ceremony late Wednesday morning for an executive order to review national monuments, Trump said he is “ never surprised by the 9th circuit.”

“We’ll see them at the Supreme Court.”

“Among less than one tenth of one percent of circuit court decisions reviewed by the Supreme Court, about 80 percent of the Ninth Circuit Court’s decisions were overturned,” according to Snopes.

After the ruling on Tuesday, White House chief of staff Reince Priebus said a federal court went “bananas” in blocking the president’s order to withhold funding from sanctuary cities.

Priebus also expressed confidence the administration would prevail if the case reaches the Supreme Court.

“It’s the 9th Circuit going bananas,” Priebus told a group of reporters Tuesday evening. “It’s clear forum shopping that’s going on in this country.”

Forum shopping is the process by which a plaintiff chooses a court likely to give a favorable ruling when multiple courts have jurisdiction.

The Obama-appointed judge in San Francisco ruled the order violated the Constitution by attempting to punish local governments by seeking to “deprive local jurisdictions of congressional allocated funds without any notice or opportunity to be heard.”

The local California governments that sued over the order argue more than $2 billion in federal funding could be at stake. The ruling will remain in place while the lawsuit moves through the court.

Trump has in the past faced criticism after attacking judges.
