Dershowitz: Nunes ‘has no case at all’ against Twitter

Attorney Alan Dershowitz on Wednesday said Rep. Devin Nunes (R-Calif.), who is suing Twitter, has “no case at all” against the social media company.

Dershowitz added during an interview on Fox News’s “America’s Newsroom” that Nunes’s lawsuit is “wrong from a political and ideological point of view.”

{mosads}”If you don’t like what Twitter is doing, create an alternate company. If you don’t like what Facebook — if you don’t like what any of the others are doing, the American way is competition,” Dershowitz, who is also an opinion contributor for The Hill, said.

“Look, a lot of people thought that the Democrats controlled the media, and along came Fox. Now you have two sides presented,” he continued. “You can watch Fox, you can watch other programs. That’s the answer. The answer is to create competing media.”

Nunes, the ranking member of the House Intelligence Committee, is suing Twitter and some of its users for more than $250 million.

Nunes alleges that Twitter has censored conservative voices on the platform by “shadow-banning them.” He has also accused the social media giant of “facilitating defamation on its platform” because, he alleges, the company has ignored “lawful complaints about offensive content and by allowing that content to remain accessible to the public.”

But Dershowitz said Wednesday that Nunes’s defamation accusation also won’t hold up in court.

“The law in the United States is you can’t defame a group, you can’t defame conservatives, you can only defame individuals,” he said. “And if you’re a public figure, in order to be defamed, you have to prove reckless disregard for the truth. It’s going to be very, very hard to do.”
