Texas lawmaker files resolution to overturn EPA nitrogen oxide rule
“This attempted regulatory action by the EPA is precisely the kind of
situation for which the CRA was intended as a legislative remedy,”
Carter said in a statement. “Congress has a responsibility to provide
oversight over the activities of all federal agencies, to ensure that
unelected bureaucrats don’t abuse their legal authority, as it appears
they have in this case.”
The state of Texas has instituted what it calls a “flex plan” for reducing nitrogen oxide emissions from major facilities. EPA has moved to change the plan, arguing that the emissions reduction method is not adequate.
It’s the latest effort by Texas officials to push back against the EPA. The agency has also taken over the reponsibility of issuing greenhouse gas permits in the state after state officials refused to comply with EPA climate standards for new or modified facilities. Texas Gov. Rick Perry (R) and other state officials have reeled against
EPA’s efforts to limit greenhouse gas emissions.
House Energy and Commerce Committee Chairman Fred Upton (R-Mich.) has
said he will
consider using the Congressional Review Act to challenge EPA’s
climate rules.
