Top health official wasn’t consulted on mandate delay

Tavenner, testifying Wednesday before a subcommittee of the House Oversight and Government Reform Committee, said she has been in the loop throughout the overall implementation effort, but the decision to delay the employer mandate was made after consultation with the Internal Revenue Service, not CMS.

The IRS is the primary enforcer of the employer mandate, which requires large employers to offer healthcare coverage to their full-time workers or pay a penalty.

CMS, though, contains the office implementing the bulk of the healthcare law, including new insurance marketplaces in each state.
