Bono Mack emphasized that the 100 million consumers whose data was breached are also victims. She said the firm’s delay appears aimed more at protecting itself than
protecting consumers and might have increased the risk of identity
theft.
As chairman of the Energy and Commerce Manufacturing sub-panel, Bono Mack
is preparing data breach legislation for introduction later this year. She said the bill could include guidelines for when and how firms should notify customers after an attack.
She called the company’s decision to initially notify consumers via blog post a passive notification and suggested an email immediately after the attack would have been preferable. She declined to specify what an appropriate time frame for the notification would have been.
