This week in regulation

Members of the House of Representatives are in town for quick three-day legislative session this holiday-shortened week, and the Senate is out altogether. But fear not: the Federal Register keeps churning, and there’s plenty of regulatory news on the horizon in the coming days.

Including:

On Tuesday morning, the Supreme Court is expected to announce opinions, which could include a handful of cases with major implications for regulations and the limits of executive branch power – including the closely watched National Labor Relations Board v. Noel Canning and Texas v. Environmental Protection Agency.

The U.S. Chamber of Commerce is slated to hold a presser Wednesday morning to detail a new report highlighting the likely economic implications of the EPA’s forthcoming power plant rule. The EPA is planning a major rollout next week for its proposal to impose new limits on existing power plants.

Also Wednesday, the House Energy and Commerce Committee will mark up the Improving Regulatory Transparency and New Medical Therapies Act, a bill designed to force the Drug Enforcement Agency to move faster on scheduling decisions.

Top Chef Judge Tom Colicchio and Rep. Rosa DeLauro will hold a conference call Wednesday afternoon to rail against the House GOPers fighting against nutrition standards championed by first lady Michelle Obama.

On Thursday, the House Small Business Committee will convene a hearing to delve into potential impacts of the EPA’s ever more contentious “Waters of the United States” rule, a proposal to expand the agency’s regulatory authority to smaller bodies of water.

Also Thursday, Homeland Security Secretary Jeh Johnson will testify before the House Judiciary Committee. It’s a good bet that he’ll be grilled on the Obama administration’s consideration of more forceful executive action on immigration.
