Supreme Court watcher betting on administration in ObamaCare challenge
The Supreme Court is more likely to rule in favor of the Obama administration in the King v. Burwell ObamaCare challenge, according to a seasoned attorney who watched oral arguments on the case.
“I would put my money on the court ruling in favor of the government,” Kevin Russell told The Hill’s Molly K. Hooper. “I think, in part, because of Justice Kennedy’s questions that made it seem like he was looking for a way to rule in favor of the government and the fact that the chief justice – who voted in favor of ObamaCare last time – didn’t ask any questions hardly at all.”
{mosads}Russell, a partner at Goldstein & Russell P.C., a firm specializing in cases before the Supreme Court, noted that the administration says that a decision striking down subsidies “risks putting the entire law into a death spiral because lots of people will not be able to afford insurance … so you will have lots of people not getting insurance until they get sick and then that will just put the entire system out of kilter.”
The court is expected to hand down a ruling before recessing the 2014 term at the end of June.
